Elder Planning Isn't Just For The Elderly

Nursing home malnutrition may give rise to lawsuit

We all hope that when our loved ones age, they will be able to remain independent and care for him or herself. In the event that this reality is out of reach, we often find ourselves hoping that family and friends can step in to help out when needed. Yet, in many instances, even this is not enough to provide an elderly loved one with the care and supervision they need. This is why so many New Yorkers turn to nursing homes that they trust will keep their loved one's safe and healthy.

Although many nursing homes provide exceptional services, sometimes these institutions and their employees act in a way that results in nursing home abuse or neglect. This may manifest itself in one of a number of ways, including physical injuries and bedsores. But the horrors of nursing home neglect don't end there. In fact, sometimes elderly nursing home residents are left without adequate food and water, resulting in severe dehydration and malnutrition.

Malnutrition occurs when an individual is fed too little or is given food that does not have the appropriate nutritional content. Signs of malnutrition may include weight loss, poor wound healing and dental problems. It is important that malnutrition is addressed right away, as it can have significant effects, including a weakened immune system. In an elderly individual, this means he or she may be less likely to overcome an illness or infection, thereby increasing their risk of death.

When an individual is injured or killed in a nursing home by something like malnutrition, the victim and even family members need to consider the nursing home's role in the matter. If neglect contributed to the harm caused, then it may be appropriate to pursue a personal injury lawsuit. Doing so could not only lead to the recovery of much needed compensation, but it might also help a family obtain a sense of justice and closure.
